These Terms define yours and Face Flex’s rights and obligations. The most current version of these Terms can be accessed at any time at www.thefaceflex.com (the “Site”).
By accessing, browsing, and/or using the Site and/or any facility operated by Face Flex, you accept and agree to be bound to these Terms. In addition, when using particular Face Flex services, you also shall be subject to any posted guidelines, FAQs, or rules applicable to such services, which may be posted and modified from time to time.
2.1 “We” are The Face Flex Cosmetic & Personal Care Limited, a privately held company registered in Dubai International Financial Center (DIFC), Dubai, UAE and under license number CL8099 and our registered address is RT-207, Level 1, Retail Floor, Index Mall, DIFC, Dubai, UAE. (“We”/“Us”/”Our”).

2.4 The “Terms” shall be governed, in all respects, by the laws of the DIFC authority, Dubai - UAE, without regard to conflict of law provisions. You agree that any claim or dispute against Us must be resolved by the DIFC Courts, except as otherwise mutually agreed by both the parties.
We reserve the right to alter, suspend or discontinue any aspect of Our Website or the content or available through it, including Your access to it. Unless stated otherwise, any new features including new content, and/or the sale of new products and/or services shall be subject to these Terms.
4.1 The following applies to any information You provide to us, for example during any registration and sign-up process:
- You authorise us to use, store or otherwise process any personal information which relates to and identifies You, including but not limited to Your name, gender, email address, phone number and progress photos (before and after you receiving the service) to the extent reasonably necessary to provide the services which are available through Our Website by Us or our sub-contractors. All such information collected by Us shall be referred to in these Terms as “Personal Information”;
- You must ensure that the Personal Information You provide is accurate and complete and that all registration details (where applicable) contain Your correct name and other requested details;
- Prior to obtaining any service with us, we shall request you to fill our pre-visit consultation form to help us better understand your current skin health, personal history and check for any contraindications;
- We are reliant on the information provided and withholding information or providing misinformation may result in contraindications and / or irritation to the skin from the treatment undertaken;
4.2 You must read Our Privacy Policy which contains important information about the use of Your Personal Information and other information regarding Your Privacy.

4.4 By using Our website and any service or products offered by us you agree to our privacy policy published on Our website.
5.1 The following applies to any service you receive or any product you buy from Us:
- You acknowledge that your participation in receiving any of our services and buying any of our products is voluntary and that you have sought approval of your doctor, where applicable
- You agree to hold Us entirely free from any liability, including financial responsibility for any injuries incurred. You release, waive, discharge and covenant not to sue Us for any claim or liability arising of or related to the services you have received or the products you have purchased.
You are solely responsible in all respects for all use of and for protecting the confidentiality of any username and password that may be given to You or selected by You for use on Our Website and / our booking platform. You may not share these with or transfer them to any third parties. You must notify Us immediately of any unauthorized use of them or any other breach of security regarding Our Website that comes to Your attention.
7.1 Your use of Our Website and its contents grants no rights to You in relation to Our intellectual property rights including, without limitation, trade marks, logos, graphics, photographs, animations, videos and text or the intellectual property of third parties in Our Website and its contents.
7.2 You may not copy, reproduce, republish, download, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, edit, communicate to the public or distribute in any way the services, web pages or materials on the Website or the computer codes of elements comprising the Website other than for Your own personal use.

7.4 By submitting information, text, photos, graphics or other content to Us via Our Website and / or our booking platform, You grant Us a right to use such materials at Our own discretion including, without limitation, to edit, copy, reproduce, disclose, post and remove such materials from Our Website.
8.1 As a result of viewing Our Website We may log certain information about You by using cookies. Cookies are small files which are stored upon the hard drive of Your computer. We may use cookies to:
- measure the number of visitors to Our Website;

- use Our Website in any way that may lead to the encouragement, procurement or carrying out of any criminal activity;
- use Our Website in any way that interrupts, damages, impairs or renders the Website less efficient;
- use Our Website for any purpose other than Your personal use;
- email, transmit or otherwise disseminate any content which is defamatory, obscene, in breach of copyright, vulgar or indecent or may have the effect of being harassing; threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability;
- advertise or promote third party or Your own products or services including by way of the distribution of ‘spam’ email;

9.2 We reserve the right to suspend, restrict or terminate Your access to Our Website at any time without notice at Our discretion if we have reasonable grounds to believe You have breached any of the restrictions above.

9.4 You agree to compensate Us from any claim or damages (including any legal fees in relation to such claim or damages) made by a third party in respect of any matter in relation to or arising from Your use of Our Website including any breach or suspected breach of these Terms or Your violation of any law or the rights of a third party.
10.1 We will try to make Our Website available but cannot guarantee that Our Website will operate continuously or without interruptions or be error free and can accept no liability for its unavailability.
10.2 Access to Our Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond Our control.
11.1 Under no circumstances, including, but not limited to, negligence, will Face Flex be liable for any special, indirect, incidental, consequential, punitive, or exemplary damages arise from or related to the use of Our facilities or services received from Us or the products sold by Us, or any other interactions with Face Flex, even if Face Flex or a Face Flex authorized representative has been advised of the possibility of such damages.
11.2 In all cases, our liability in tort, contract, negligence, pre-contract or other representations or otherwise arising out of or in connection with these Terms shall be limited in aggregate to the net payment to Us from You for the services or products sold to You.
11.3 All content and services on Our Website are provided on an ‘as is’ and ‘as available’ basis. We do not make any representation or give any warranty (whether express or implied) in respect of Our Website or its content, including, without limitation, any advice given (on a personal or general basis) and statements made by advertisers on or via the Website. Nothing in these Terms shall restrict Your statutory rights (including Your rights to receive a reasonable standard of service).
11.4 . We do not accept liability for damage to Your computer system or loss of data that results from Your use of the Website. We do not guarantee or warrant that any material available for downloading from Our Website will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy Your particular requirements for the accuracy of data input and output. You are responsible for ensuring that Your computer system meets all relevant technical specifications necessary to use Our Website and is compatible with Our Website.
11.5 Neither you nor Face Flex will be held liable for any failure to perform any obligation to the other due to causes beyond Your or Our respective reasonable control.
Please be aware that if you need to change or cancel your service bookings or masterclass enrollments, we ask that you give us 24 hours notice or the full cost of the service or masterclass, as applicable, will be charged with no refund.
Please arrive 10 minutes prior to your scheduled appointment time so we can check you in.
If you are running late, out of consideration for the next customer we may shorten the time of your service. If this is not possible your appointment will be treated as a cancellation and you will be charged the full price of the workout booked.
Please be aware that whilst we will do our best to hold your appointment slot for you, if you are more than 15 minutes late, we may give the space to another client.
14.1 All sales of commitments are pre-paid, final and non-refundable.
14.2 All commitments come with a validity period. The validity period (mentioned per commitment) is non-extendable. You cannot freeze your Commitments. You acknowledge and agree that any unused services or products or benefits will forfeit if not used/ redeemed within the validity period and no refunds issued.
14.3 You accept that Commitments are non transferable and are to be used only by you.
14.4 We reserve the right terminate your Commitments upon written notice to you for any reason or no reason without the need to refund on any unused services or products or benefits.
14.5 Our standard cancellation terms provided in section “CANCELLATION OF WORKOUTS & MASTERCLASSES” apply to all bookings made as part of your Commitments. If you do not reschedule prior to the 24 hour period and are a cancel/no show, the service will be redeemed from your commitment package in place of the no show.
14.6 No discounts or promotion codes are applicable to Commitments.
Our gift cards are redeemable as part or full payment for services or products and must be presented at checkout when purchasing. Discounts or promo codes cannot be used to buy gift cards. Gift cards are valid for a period of twelve months from the date of purchase, are non-refundable and cannot be redeemed for cash.
16.1 Please note that all products available on Our Studio are for your personal use only. You may not sell or resell any of the products.
16.2 We reserve the right to cancel or reduce the quantity of any orders that we believe may result in the violation of our Terms.
16.3 No refund will be issued once the product has been purchased.
17.1 Discounts and promo codes are not transferable and not redeemable for cash, credit or toward purchases.
17.2 Please note, discounts and promo codes cannot be used in the following situations:
- In conjunction with any other offer (including promotional sales).
- On Gift Cards purchases
- On Product purchases.
- On Commitments purchases.
17.3 We reserve the right to modify or cancel the discount at any time without prior notice.
17.4 Use of Discounts & Promo Codes is limited to one use per customer and restricted to one email address per customer and we have the right to decline use of the code or reclaim the amount of any discount or credit, both online and in studio if it is believed to be abused.
17.5 We reserve the right at any time to limit the amount of bookings using discount and promo codes; particularly at peak times (e.g. public holidays, weekends etc.).
When using our services or products, you will be subject to any additional posted guidelines or rules applicable to specific products or services which may be posted from time to time (the “FAQs”). All such FAQs are hereby incorporated by reference into these Terms.
You agree to assume full responsibility, to the maximum extent permitted by law, for Your use of Our facility or services or products offered by Us. You release Face Flex from any and all loss, theft, claim, injury, damage, or liability, including claims arising from the negligence of Face Flex, its affiliates, agents, or employees. Additionally, you agree that Face Flex shall not be liable for any special, indirect, consequential, or punitive damages, including loss of profits, business, or anticipated savings, whether arising in contract, warranty, negligence, tort, under statute, in equity, at law, or otherwise, in connection with or as a result of the transactions contemplated hereby. Furthermore, You agree to indemnify, defend, and hold harmless Face Flex and its employees from any and all liability arising out of Your presence at our facilities or services or products offered by Us.
